Restaurant Operators Report Stronger Sales, Improving Traffic in August
Conditions in the restaurant industry strengthened for the fourth straight month as operators saw higher same-store sales and improving customer traffic, according to the latest Restaurant Performance Index from the National Restaurant Association. The index stood at 100.6 in August, a 0.3% improvement from July and the highest reading since February. The index is designed to measure the overall health of the restaurant industry, with any value over 100 indicating a period of expansion.

NAW Files Reply in Challenge to Colorado’s Packaging EPR Law
As part of its efforts to gain a preliminary injunction blocking Colorado’s extended producer responsibility (EPR) law for packaging, the National Association of Wholesaler-Distributors (NAW) submitted new documents on Sept. 28 contending that the state has not answered its main constitutional arguments. In the filing, NAW argues that Colorado’s defense rests on two claims it says do not hold up. First, NAW says Colorado characterizes membership in the Circular Action Alliance (CAA), the private organization that administers the state’s EPR program, as voluntary. That is inaccurate, NAW states, because the law makes joining CAA a condition of selling covered products in the state. Second, Colorado maintains that its Department of Public Health and Environment controls CAA. NAW argues that the department does not provide the level of oversight the U.S. Constitution requires before a private organization may exercise government power.

Bipartisan Senate Deal Would Streamline Energy, Infrastructure Permitting
Under the current permitting process, duplicative permitting delays cost manufacturers nearly $8 billion annually, and the weighted-average permit approval time is 10 months, according to data from the National Association of Manufacturers. The proposed legislation, dubbed the Bipartisan American Affordability and Jobs Act, aims to speed up the timetable while maintaining a commitment to environmental stewardship. To accomplish that streamlining, the 417-page bill would reform parts of the National Environmental Policy Act (NEPA), Clean Water Act, Endangered Species Act, Federal Power Act, and National Historic Preservation Act. It would also provide project certainty once federal permits are issued, impose new agency decision deadlines, and narrow several judicial review windows.

From FEDA News & Views: The Labor Issues Distributors Can’t Afford to Ignore
Legislative sessions have been busy this year as lawmakers introduce and debate new measures affecting employee compensation and management. Federal and state agencies are also revising regulations, while the White House’s new executive orders are changing employment-related policies in areas like federal contracting and workforce rules. Some of the proposals have bipartisan support and are advancing relatively quickly, but others are taking longer as lawmakers debate, revise, and negotiate their provisions. For distributors, tracking all this activity can feel like an all-consuming distraction that detracts from running the business. Yet falling behind carries real risk — from penalties and employee disputes to legal challenges that can be costly to resolve.
